Yogyakarta Principles (Principle 24), UPR Mechanisms and UN Definition of Families

Yogyakarta Principles: The Right to Found a Family
Everyone has the right to found a family, regardless of sexual orientation or gender identity. Families exist in diverse forms. No family may be subjected to discrimination on the basis of the sexual orientation or gender identity of any of its members.
More details: http://www.yogyakartaprinciples.org/principle-24/
UN Definition of Families
During the 31st session of the Council, the High Commissioner for Human Rights presented his report on the Protection of the family, recalling the lack “definition of the family under international human rights law” and the need to “recognize the diverse and changing forms of the family institution, in accordance with the different social, cultural and economic characteristics of every society; the promotion of equality between men and women; and the effective protection and promotion of the rights of women, children, persons with disabilities, older persons and any other family member, without distinctions. Moreover, ensuring universal access to sexual and reproductive health services, including family planning, should be an integral part of development efforts.”

The report notes that “international standards set forth at least two minimum conditions for the recognition and protection of families at the national level: first, the respect for the principle of equality and non-discrimination, including the equal treatment of women; and second, the effective guarantee of the best interest of the child”, adding that “the Committee on Economic, Social and Cultural Rights has called upon States to provide legal recognition of same-sex couples.”
Regarding children’s rights, the report highlights that “Children should be recognized as rights holders.” “International human rights law protects children from being discriminated against within the family on the basis of gender, disability, family status or any grounds.”
CRIN Child Rights International Network: These include entrenched conceptions of family and norms that are inconsistent with human rights and the principle of nondiscrimination. Patriarchal family structures, for example, are known to solidify the cultural construction of gender and allow for gender based discrimination and violence against women and girls to endure. And a heteronormative conception of family fails to recognise the diversity of family structures and sexual orientations, which can result in the abandonment or abuse at the hands of family members of children who identify as lesbian, gay, bisexual or transgender. https://www.crin.org/sites/default/files/crin_submission_protection_of_the_family.pdf
IFED
The first International Family Equality Day (IFED) was launched in 2012 as a sign of solidarity and pride to promote equality for all families. The 5th International Family Equality Day in 2016 was commemorated in 74 towns and 36 countries worldwide, whether on a smaller scale with picnics, gathering together, celebrating in safe spaces or with big public events. The Council of Europe recognises the IFED as an important tool to combat homophobia and transphobia and to promote a tolerant and cohesive society.

About Pink Alliance:

“The Pink Alliance (aka Tongzhi Community Joint Meeting or TCJM) aims to link tongzhi organizations operating in Hong Kong, so as to assist them in their work and to provide a network for information in both Chinese and English within the tongzhi community. We also research and campaign on issues of key importance. Tongzhi (同志), a Chinese phrase, is often translated as ‘comrade’, which refers to people of different sexual orientations and gender identities in the Chinese-speaking world. Whether through advocacy work or cultural activities, we aim to advance social recognition of tongzhi as valuable members of society.”

Additionally, the Women Coalition Hong Kong (WC HK) commemorated IDAHOT with a special event under the theme ‘LGBT victims of Domestic Violence need true protection’

Since then, two kinds of LGBT domestic violence is under legal protection: domestic violence between same sex cohabitation partners and domestic violence among family members of LGBT persons, such as, abusive behavior towards LGBT sons and daughters by their own parents.

Nevertheless, no true social support exists for LGBT victims of domestic violence. The Hong Kong Government’s Social Welfare Department did not provide suitable support for LGBT victims of domestic violence. Moreover, the Police have not updated the definition of domestic violence to include domestic violence amongst family members of LGBT persons. Thus, those cases are neglected and ignored in the system.

In the street action of International Day against Homophobia, Transphobia and Biophobia 2015, we call for changes in the policies by the Social Welfare Department and the Police to support LGBT victims, especially LGBT youths who are abused by parents. This echoes the global theme of International Day against Homophobia, Transphobia and Biophobia 2015.

Hong Kong saw a great variety of actions during the week around IDAHOT 2014. Organized by an alliance of four human rights organizations (Pink Alliance, Pink Season 粉紅天, Amnesty International Hong Kong, and Transgender Resource Center), the IDAHOT-HK committee was set up to coordinate the 2014 IDAHOT-HK event series.

RainbowLaces social media campaign

The series kicked off with the #RainbowLaces social media campaign. During the first two weeks of May, Hong Kong’s twittersphere was blasted by the pictures of rainbow laces that the Committee produced and distributed to build awareness in the lead up to the Day. Under the theme of “Express yourself, express your rights, express your support!”, ANZ Bank sponsored the rainbow laces campaign.

Transgender Awareness Session

In partnership with Standard Chartered Bank, the series continued by hosting an Active Transgender Awareness Session on May 14th, as a way of putting specific emphasis on the importance of equal rights for transgender communities in Hong Kong.

Candlelight Vigil

The commemorations of IDAHOT 2014 continued further when the IDAHOT Candlelight Vigil took place on May 16th. At the vigil event, organisers screened a series of short videos and presented a panel discussion which shed light on stigma and discrimination, as experienced by LGBT individuals in Hong Kong and worldwide. Amongst the panelists were Geena Rocero, an American/Filipino trans supermodel who recently rose to fame by bravely sharing her coming out story via TEDTalk. Rocero spoke out on the need for expanded legal rights for all trans individuals.

Accompanying Rocero on the stage, Michael J. Morrill, Mr Gay Hong Kong 2013, also shared his experiences of the stigma he faced on a daily basis, as an openly HIV-positive gay man.

The event ended with the audience lighting up candles in remembrance of the victims of hate crimes from Hong Kong’s LGBT community, and from around the world.

Street Exhibition

On May 17 itself, a street exhibition showcasing the discrimination that LGBT people are facing internationally and locally was organized by Gay Harmony, Women’s Coalition of HKSAR and , and Rainbow Action. Aiming to raise awareness of the suffering of LGBT people, and to promote anti-discrimination legislation around sexual orientation and gender identity, the exhibition graced the pedestrian lanes of Great George Street at Causeway Bay, with art installations and performances. The organisers also held a ‘Domino down’ event – building a legislative Rainbow Road, where over 400 domino bricks (as a symbol of discrimination) were knocked down to show the six-color rainbow as a symbol of equality.

Fighting ‘In.Justice’ – LGBT Rights Rally, May 12

An LGBT rights rally was also held for IDAHOT, on May 12 (Mother’s Day in Hong Kong). Organisers – the Hong Kong Pink Alliance together with Amnesty International HK – advised, in the lead-up to the event:

‘The theme this year is “In.Justice” , to reflect the lack of legal protection from discrimination for different sexual orientations and gender identities while such legislation is still distances away. At the rally, different sexual minorities organisations, through speeches or performances, will express their frustration and remember those who suffer along the way. Guests and performers include : Equal Opportunity Commission Chairman Mr. York Chow, Singer Anthony Wong, Boyband C-AllStar, Legislators “Slow Beat” Ray Chan and Claudia Mo.’

This year, the 8th International Day Against Homophobia and Transphobia Hong Kong rally (IDAHOT) was themed “What To Fear?!” with aims to eliminate homophobic and transphobic bullying in Hong Kong, and to commemorate victims of bullying in past years.

Rally was held on 12 May at Chater Garden, Central, Hong Kong. It had a turn out of 600 LGBT and allies. It was an important day because Cantopop star Anthony Wong (who had recently come out at his concert) sang to the audience. It was also supported by politicians from various political parties. More details of the program which included the presentation of the 2012 LGBT climate study here .

In addition, a coalition of activists in Hong Kong held a “Who Stole our LGBT Movement?” street forum to commemorate IDAHO 2012.

The forum featured discussions on the latest strategies for the LGBT movement in Hong Kong, an analysis of homophobia around world, and a review of the collaborations between LGBT organizations and civil society.
